Welcome to WilloSend. By accessing or using our website, platform, and services (collectively, the "Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our Service.
1. The Service
WilloSend provides an automation platform that allows Instagram creators and businesses to automatically reply to comments and send Direct Messages (DMs) to their audience. We operate using approved official Meta API. However, we are an independent entity and are not owned or operated by Meta Platforms, Inc. or Instagram.
2. Account Responsibilities
To use WilloSend, you must have a valid Instagram Professional (Creator or Business) account. You are responsible for maintaining the security of your WilloSend account and the associated Meta authentication tokens. You agree not to use WilloSend for any illegal or unauthorized purpose. You must not violate any laws in your jurisdiction or the official terms of service set forth by Instagram.
3. Acceptable Use & Spam
WilloSend is designed to facilitate engaged, opt-in conversations. You agree to use the platform responsibly. You explicitly agree not to use WilloSend to:
- Send unsolicited spam messages, phishing links, or malicious content.
- Automate harassment, hate speech, or abuse.
- Artificially inflate engagement metrics in violation of Instagram's Community Guidelines.
We reserve the right to immediately suspend or terminate any account that violates these acceptable use standards, without refund.
4. Billing and Subscriptions
WilloSend is a subscription-based service. By subscribing to a paid plan, you agree to pay all applicable fees on a recurring basis (monthly or annually) until you cancel. We offer a 1-free-overage policy for unexpected viral posts, ensuring your automations are not interrupted if you slightly exceed your plan limits once. However, sustained usage above your tier will require a plan upgrade. You may cancel your subscription at any time; however, there are no refunds for partial months of service.
Our billing is handled by DodoPayments, a third-party payments provider. We do not store your payment information on our servers. All payments are processed securely. Please note that in the event of a refund, only the purchase amount will be refunded; third-party processing charges and transaction fees are non-refundable.
5. Limitation of Liability
While we strive for 100% uptime, WilloSend relies on the Instagram API. We cannot guarantee uninterrupted service if Instagram experiences downtime or changes their API terms. In no event shall WilloSend, its directors, or employees be liable for any indirect, incidental, or consequential damages—including loss of profits, data, or audience engagement—arising out of your use of the Service or any suspension of your Instagram account by Meta.
6. Changes to Terms
We may modify these Terms of Service at any time. We will notify active users of any significant changes via email or an in-app notification. Continued use of the Service after such changes constitutes your acceptance of the new terms.
